Terms of use

These terms govern your use of www.distrobay.com, the waitlist, and the DistroBay product application (together, the “Service”). By using the Service you agree to these terms.

1. Early access

DistroBay is in early access. Features may change, break, or be removed. Marketing pages describe the intended product experience; individual shops, marketplaces, and capabilities may not all be available at the same time. Joining the waitlist does not guarantee access on a particular date.

2. Accounts

You must provide accurate information and keep credentials secure. You are responsible for activity under your account and workspaces you own or administer. You must be able to form a binding contract (generally 18+) and use DistroBay for lawful business selling.

3. Acceptable use

• Do not misuse the Service, attempt unauthorised access, or disrupt others.
• Do not upload unlawful, infringing, or deceptive product content.
• Do not use DistroBay to spam marketplaces or violate shop or marketplace terms of service.
• Respect rate limits and automated-access rules.

4. Your content and connected shops

You retain ownership of product photos, notes, and listing content you provide. You grant DistroBay a licence to host, process, and transmit that content as needed to provide the Service (including AI-assisted generation and push to shops you connect). You are responsible for the accuracy of listings and for complying with Shopify and other shop policies, Australian Consumer Law, and GST/tax obligations.

5. AI-generated output

Listing copy and suggestions are AI-assisted drafts. You must review and edit before publishing. DistroBay does not guarantee search rankings, sales outcomes, or error-free output. Default push targets are drafts where the connected shop supports it.

6. Intellectual property

DistroBay branding, software, and site content are owned by DistroBay or its licensors. You may not copy or reverse engineer the Service except as allowed by law.

7. Third-party services

The Service integrates with third parties (for example Google/Firebase, Shopify). Their terms and privacy policies apply to those services. Outages or policy changes at third parties may affect DistroBay.

8. Fees

Early access pricing will be communicated to waitlist members. Paid plans, if offered, will be billed in AUD unless stated otherwise. Taxes (including GST) may apply.

9. Disclaimer and liability

To the maximum extent permitted by Australian law, the Service is provided “as is” without warranties of uninterrupted or error-free operation. Nothing in these terms excludes non-excludable rights under the Australian Consumer Law. Where liability can be limited, it is limited to resupply of the Service or the amount you paid us in the prior 12 months (whichever is greater, or AUD $100 if you have paid nothing).

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or discontinuation of the product. Provisions that should survive (IP, liability, governing law) will survive.

11. Governing law

These terms are governed by the laws of New South Wales, Australia. Courts of NSW have non-exclusive jurisdiction, subject to any non-excludable consumer rights where you live.
